This letter is to provide public notice of the opportunity to offer comment on Texas’ application to renew its waiver authority under the Education Flexibility (Ed-Flex) Program.
Texas has participated in the Ed-Flex Program since its inception under the Education Flexibility Partnership Act of 1999. Through this program, the Texas Education Agency (TEA) has been able to provide increased flexibility to local educational agencies (LEAs) as they implement select federal education programs under the Elementary and Secondary Education Act, as amended by the Every Student Succeeds Act of 2015 (ESSA).
Under this statute, Texas has the authority to waive provisions of the following federal programs to assist LEAs in designing and implementing the programs in ways that best meet the needs of their students and communities:
- Title I, Part A (other than Section 1111)
- Title I, Part C
- Title I, Part D
- Title II, Part A
- Title IV, Part A
- Carl D. Perkins Career and Technical Education Act of 2006
Information on the types of waivers available under the State’s current Ed-Flex authority is available on the TEA Ed-Flex web page.
A draft of the State’s application to renew its waiver authority under the Ed-Flex Program is posted on the TEA Ed-Flex web page, at https://tea.texas.gov/Finance_and_Grants/Grants/Ed-Flex_Waivers, and will remain available for public comment through July 30, 2019.
Comments related to the application may be submitted to ESSASupport@tea.texas.gov.
All comments received will be included in TEA’s application to the U.S. Department of Education.
